Forty Percent of AT&T’s iPhone Subscribers Could Flee to Verizon

What will AT&T’s post-paid subscriber numbers look like if the company loses its iPhone-exclusivity deal with Apple and if Verizon begins selling the device, as some believe it soon might?

The numbers will look about six million subscribers lighter than today, according to Davenport & Company analyst Drake Johnstone, who believes AT&T (T) will take a nasty hit if/when Verizon (VZ) receives Apple’s (AAPL) blessing to sell the iPhone.

“Over the past several years, AT&T indicated that 40 percent of its new iPhone customers came from other carriers,” Johnstone theorized in a note to clients this week. “We estimate that AT&T has 15 million iPhone customers (as of Q-1 10) and believe that AT&T could lose as many as 6 million, or 40 percent, of its iPhone customers when Verizon begins selling the iPhone in 2011.”

As a consequence, the analyst noted that “We are reducing AT&T’s 2011 wireless subscriber additions from 6 million to 2 million (most of these new additions may be lower value connected devices such as eReaders instead of higher value long-term wireless customers), since we believe that Verizon could obtain Apple’s approval to sell and provide wireless service for the iPhone as early as mid-2011.”

A 40 percent drop in iPhone subscribers. Six million AT&T customers gone with the advent of a Verizon iPhone. That’s an ugly scenario for AT&T, for which the device has been a major driver of wireless revenue growth.

But it’s not necessarily an inevitable one. As I noted here just yesterday, subscriber losses triggered by the end of AT&T’s iPhone-exclusivity deal will be tempered by two very important factors:

  1. The early termination fee AT&T charges customers who break their contracts.
  2. Family-talk and business-discount plans that make switching to a new carrier a difficult proposition. About 80 percent of AT&T’s customers are on such plans.

Beyond this, there’s the simple fact that subscriber churn rates at carriers that have lost iPhone exclusivity hasn’t been all that bad. As Matthew Key, CEO of Telefónica Europe said during a February earnings call, “ever since Vodafone has started selling the iPhone in January, we see absolutely no evidence of people leaving us, churning on the iPhone going back to Orange or Vodafone, so [we are] very comfortable with our iPhone volumes. We continue to out-trade the market and no sign of churn whatsoever.”

The lawyers who do most of the jousting over Internet copyright issues were abuzz last week after learning that a federal court judge suggested one of the more prominent among them had advised clients to destroy evidence.

On Wednesday, U.S. District Court Judge Kimba Wood issued a 59-page decision in Manhattan granting summary judgment in favor of the Recording Industry Association of America in its long-running copyright fight against file-sharing service LimeWire. The order opened the door for the top four record companies to force a closure of the service.

Sirius Kicking Butt in 2010

Hard to believe: A year ago, Sirius XM Radio shares were trading at around 35 cents and the company was on its way to being slapped with a Nasdaq minimum-bid notice. Today, Sirius shares are trading at $1.15, up nearly 7.5 percent on news of an improved full-year outlook.

The recovery in consumer spending and auto sales is evidently giving Sirius (SIRI) quite a lift, enough for it to boost projected new subscriptions to approximately 750,000 from about 500,000, its revenue to $2.75 billion and its profit to $575 million.

Quite a change from last year, when the company seemed headed toward almost certain bankruptcy. Its shares are up some 75 percent this year.

Path of 3-D Technology Leads Inevitably to Playboy

The monthly men’s magazine is about to unveil its first 3-D centerfold, which will appear in the June issue hitting newsstands on Friday. It will show 2010 Playmate of the Year Hope Dworacyzk in a “seductive” pose the publisher says will “come to life before readers’ own eyes.”

The spread is the culmination of a half-century-old quest by Playboy founder Hugh Hefner. “I wanted to create a 3-D pictorial for the very first issue of Playboy, but didn’t have enough money to include the 3-D glasses,” Mr. Hefner said in a release.

Whether nudity looks better from behind those glasses is unclear. For Playboy, though, it’s worth a try. The monthly magazine has been hurt in recent years by the proliferation of options for porn on television and the Web. Attracting readers and advertisers to an old medium now requires twice the effort.

HBO is sponsoring the centerfold as part of a promotion of the launch of “True Blood” Season 3, the award-winning vampire series premiering on June 13th. The spread is accompanied by a “True Blood” ad, a free pair of 3-D glasses and a data sheet with vampire-related facts.

Oh, There’s a Market for Tablets All Right, Sony. Just as There Was a Market for, Ahem, iPods.

Sony isn’t convinced there’s a market for tablet computers, though Apple has sold more than a million of them since April and Intel (INTC) this week predicted that the tablet market will grow from 73 to 88 percent between now until 2014.

“We have been taking a deep look at developing a tablet for a number of years, not just because of Apple but because it creates some interesting opportunities,” Sony Information Technology Products SVP Mike Abary told Bloomberg this week.

“The iPad has created a new opportunity,” Abary added. “Now we can get a good judgment as to whether the market is truly accepting of it. [We’re] not convinced there is a large enough market to justify bringing out a tablet.”

So, Sony (SNE) is taking a wait-and-see approach to Apple’s (AAPL) iPad.

Odd considering where a similar approach to the iPod left the company.

Capellas to Run Cisco, EMC Ventures

Cisco Systems Inc. and EMC Corp. picked veteran technology executive Michael Capellas to lead two multi-company organizations that the tech giants formed last year to push a concept called cloud computing to corporate customers.

Mr. Capellas, 55 years old, will lead what the two companies call the Virtual Computing Environment coalition. He will also become chief executive officer of a Cisco-EMC joint venture called Acadia, which also received funding from Intel Corp. and VMware Inc. The moves are expected to be formally announced Thursday.

Why the Cable Guys Should Stop Worrying and Learn to Love the FCC

Hey, cable guys (and cable investors): No need to freak out about the Federal Communications Commission. At least, not yet.

That’s the counsel from Barclays analyst James Ratcliffe, who thinks concern about FCC head Julius Genachowski’s “third way” proposal is overblown.

Genachowski’s plan–in short, he wants the power to regulate broadband, but promises not to really regulate broadband–shouldn’t have surprised the market. Because that’s basically what he’s been saying for some time. But yesterday cable stocks like Comcast (CMCSA) and Time Warner Cable (TWC) tanked (before everything else tanked) on his most recent pronouncements.

Relax, says Ratcliffe. He thinks the “network neutrality” framework Genachowski wants to install won’t “limit broadband providers from doing anything they reasonably could have expected to do anyway.”

And he spells out exactly what Genachowski wants the power to enforce:

Section 201: Prohibits carriers from unreasonably denying service and requires that pricing for service be “just and reasonable.” In addition, the section requires carriers to connect with other carriers when the Commission finds that connection to be in the public interest.

Section 202: Prohibits carriers from engaging in “unjust or unreasonable” discrimination among customers or localities when it comes to providing or pricing services.

Section 208: Allows individuals or municipalities to complain to the FCC if the terms of the Act are violated, and requires carriers to either correct the violation or respond in writing arguing that the Act is not being violated. Importantly, the section expressly states that the lack of direct damage to the complainant is not grounds for dismissal of the complaint (in other words, there is no requirement that the complainant establish standing in order to complain).

Section 222: Requires carriers to keep customer information and customer usage information confidential. In the telecom world, this applies to call volumes and destinations, primarily. In the broadband world, it would apply to browsing habits, contents and destinations of emails, etc.

Section 254: Would expressly classify broadband as a service for which the FCC is empowered to work toward universal service, and, potentially, enable the FCC to include broadband service in the pool of services which are taxed to contribute to universal service deployment.

Section 255: Requires carriers to make their services usable by people with disabilities, if “readily achievable.”

Sure, the cable guys would like to see less of this, not more. But the cable guys have always had to work with government regulation–the only question is how much and what kind. Most important in Ratcliffe’s eyes is that, “just and reasonable” pricing clause aside, Genachowski is specifically not looking for the ability to regulate rates.

The cable guys’ worry: What if Genachowski changes his mind–or if one of his successors does?

Maybe Genachowski can allay some fears next month when he’s onstage at the D8 conference.

iPad Doing to the Netbook What the Netbook Did to the Laptop?

Apple’s iPad may not be cannibalizing sales of the company’s Macs, but it is evidently playing havoc with sales of netbooks. According to new research from Morgan Stanley (MS) analyst Katy Huberty, growth in U.S. netbook sales has been declining since January, the month during which Apple (AAPL) officially announced its much anticipated slate device.

“US consumer PC, and especially notebook, growth decelerated in January when Apple introduced the iPad and again in April when the iPad launched,” Huberty wrote in a note to clients this morning. “Given the corresponding increase in ASPs in the market, we believe much of the demand shortfall came from netbooks and low-cost notebooks.”

Adding detail, Huberty writes, “What’s more, US retail netbook unit growth decelerated to about 5 percent YoY in April from 25 percent in March and 53 percent in February, according to NPD.”

Quite a change from the first quarter of 2009, when netbook sales leapt 872 percent and market researchers were projecting that they would capture a big share of the worldwide market for the year at the laptop’s expense.

Clearly things have changed quite a bit since then, and while there are surely other factors at work here–a saturated market, perhaps (clearly 872 percent growth isn’t sustainable) and the debut of Windows 7–it’s tough not to look at the chart below (click to enlarge) and conclude that consumers in the market for netbooks just might be reappraising their needs in light of the emergence of the iPad. But whether that is the driving factor in the slowing growth of U.S. netbook sales is clearly an open question.

One final point worth making here: Apple itself is not immune from cannibalization at the hands of the iPad. According to Huberty, the device may soon begin to eat into sales of the iPod touch as well.
